Service descriptionThe term "itinerant trade" is defined in Section 55 (1) of the Trade, Commerce and Industry Regulation Act. It states:
A traveling trade is carried out commercially without prior appointment outside a commercial establishment(Section 42 (2) GewO) or without having such an establishment,
- offers goods for sale or solicits (sells) or purchases orders, offers services or solicits orders for services, whether independently or in a dependent capacity, or
- independently performs entertaining activities as a showman or in the manner of a showman
Anyone wishing to carry out a traveling trade requires a permit (traveling trade card). The term "itinerant trade" also includes the exercise of a trade. According to a decision by the Münster Higher Administrative Court (GewArch 87, 235), an artist who sells his paintings on the street is not engaged in a traveling trade.
The traveling trade license may be restricted in terms of content, issued with a time limit and subject to conditions if this is necessary to protect the general public or consumers. Under these conditions, the subsequent inclusion, amendment and addition of conditions is also permitted(Section 55 (3) GewO).
A traveling salesman is someone who moves around himself. The itinerant trader can also be an employee, as it is not important that he has his own branch. The prerequisite for this is that he acts commercially.
The offering of goods and services without an order is typical of the itinerant trade.
Section 55(1)(2) GewO covers the entire show business. This also includes cabaret, variety and show performances.
