Service descriptionIf the certificate is required for a specific dwelling, the certificate of eligibility for a specific dwelling is issued by the municipal/city administration in whose area the desired dwelling is located.
Description:
A certificate of eligibility for housing is required if a social housing apartment or an apartment that has been subsidized under the 3rd subsidy scheme is to be rented out.
These apartments may only be rented out to people who are entitled to move in and the landlord must be provided with a certificate of eligibility for housing.
Prerequisites:- The applicant must be a person seeking accommodation within the meaning of the Housing Commitment Act. A person seeking accommodation is someone who can legally and actually realize their intention to establish their residence for themselves and their family in the federal territory for a longer period of time as the center of their living relationships. Foreign nationals may only be issued a residence entitlement certificate if they have been permitted to stay for an unlimited period of time or have been permitted to stay for several years (minimum period of 2 years)
- Compliance with an income limit. A person seeking housing is entitled to move into a social housing apartment or an apartment subsidized under the 3rd subsidy scheme if their income does not exceed the income limit specified in the Second Housing Act or the income limit specified in the subsidy scheme. The relevant income limit is determined by the number of persons belonging to the family household. Accordingly, the income of all family members belonging to the household is also taken into account
- Applicants must be family members. This includes the spouse, relatives in the direct line as well as relatives in the second and third degree in the collateral line, relatives by marriage in the direct line as well as relatives by marriage in the second and third degree in the collateral line as well as foster children regardless of their age and foster parents.
Non-marital shared flats do not generally receive a certificate of eligibility. There is an exception for apartments of the 3rd funding channel from the funding year 1993 and only for non-marital shared flats with at least one child.
Required documents:- Proof of income of all family members belonging to the household by means of certificates of income for the month of application and the 11 previous months, the last pension statement or the notification of receipt of social benefits (e.g. unemployment benefit or unemployment assistance notification, notification of receipt of maintenance allowance, social assistance notification), proof of income from capital assets (interest)
- last tax assessment notice (for increased income-related expenses)
- Expellee identity card or registration certificate (for ethnic German repatriates)
- Proof under immigration law of the duration of permitted residence in the Federal Republic of Germany
- Proof of the existence of a pregnancy
- School certificate for children over the age of 16
- Proof of studies
Depending on the individual case, further documents may be required and application forms are available from the relevant administration.
