Urban land-use planning of the town of Idar-Oberstein, Oberstein district;
Development plan O-44 "Stadtquartier Wasen-/Wilhelmstraße";
Renewed public participation in accordance with Section 4a (3) in conjunction with Section 3 (2) BauGB. § Section 3 (2) of the German Building Code (BauGB) - renewed draft public consultation
At its meeting on 25.03.2026, the city council of Idar-Oberstein approved the amended draft of the development plan O-44 "Stadtquartier Wasen-/Wilhelmstraße" and decided to republish the draft in accordance with Section 4a (3) in conjunction with Section 3 (2) BauGB.
The aim of the development plan is the sustainable and future-oriented urban development of the inner-city area. The urban redevelopment measure "Soziale Stadt - Stadtquartier Wasenstraße" forms the basis for this. As part of this measure, the objectives set out in the integrated urban development concept (ISEK) are to be implemented using appropriate urban planning instruments.
The development plan area is part of the southern city center of Oberstein, in the immediate vicinity of the pedestrian zone and the train station. It is bordered to the north by the B41 federal highway and to the south by the railroad line. The total size covers an area of approx. 7.37 ha. The area of application is outlined in black on the map.

Based on the comments received from the authorities and the public, in particular from the Struktur- und Genehmigungsdirektion Nord, the plan drawing and the text provisions were amended and supplemented in individual points. The explanatory statement and the environmental report were updated accordingly.
The changes concern:
- the specification of the provisions for flood and heavy rainfall prevention,
- the introduction of additional usage restrictions in designated flood-prone areas (Wilhelmstrasse),
- the inclusion of conditional stipulations in accordance with Section 9 (2) no. 2 BauGB for parking spaces currently in private use in the area of Kasinostrasse (plots 89/1 and 103/7) and for structures that protrude into the traffic area (Wasenstrasse 25-29),
- the inclusion of further stipulations and information on nature, species and climate protection,
- graphic adjustments in relation to traffic areas as well as building boundaries and building lines in the areas of Ritterstraße 1 and 18-22, Schulstraße 7, Wasenstraße 26a/28,
- editorial clarifications on the legal application of individual provisions.
In accordance with Section 4a (3) sentence 2 BauGB, it is stipulated that comments can only be submitted on the amended or supplemented parts and their effects. The amendments made have been identified in the amendment documentation. They only affect partial aspects of the planning; the main features of the planning remain unaffected.
Pursuant to 4a para. 3 in conjunction with. § Section 3 (2) BauGB, in the version published on November 3, 2017 (BGBl. I p. 3634), which was last amended by Article 5 of the Act of December 22, 2025 (BGBl. 2025 I No. 348), it is hereby made public that the amended draft of the development plan, consisting of the plan drawing and the text section together with the amendment documentation, explanatory statement and environmental report, will be published during the following period
from 31.03.2026 up to and including 23.04.2026
on the website of the city of Idar-Oberstein at

and made available for viewing and downloading. The content of the announcement is also posted on the Internet.
The above-mentioned documents can also be inspected during the above-mentioned period at the Idar-Oberstein city administration, Stadtbauamt, Georg-Maus-Str. 1, 55743 Idar-Oberstein, room I.130, during general office hours (Monday to Friday from 8:30 to 12:00 and Monday, Tuesday and Thursday from 14:00 to 16:00).
The following documents with environmental information are available:
- Environmental report (in accordance with Annex 1 to the BauGB, structured according to the protected assets within the meaning of Section 1 (6) No. 7 BauGB) with the following information:
- Overarching objectives of regional and state planning: State Development Program IV and Landscape Program, Rhine-Hesse-Nahe Regional Spatial Development Plan
- Existing uses: no significant impairments; existing mixed-use areas, previous pollution from traffic and commercial noise
- Area, soil and geology: Predominantly heavily sealed and anthropogenically influenced soils with limited natural soil functions
- Water: Impaired water balance and limited groundwater recharge due to existing sealing and possible impact during heavy rainfall events
- Air and climate: Inner-city climatic conditions with pre-pollution from traffic and dense development as well as measures to reduce heat effects
- Animals, plants and biodiversity: Low biodiversity due to intensive use of the area; no protected areas or legally protected biotopes affected
- Landscape and recreation: No particular significance for the landscape of the planning area; improvement of the quality of stay through planned open space design
- Cultural heritage and other material assets: Existence of several cultural monuments and monument zones; consideration of monument preservation concerns in the planning process
- People: Existing pollution from traffic and rail noise; ensuring healthy living and working conditions through noise control measures
- Four comments from authorities and other public agencies as well as from the public with an environmental focus on the following topics: Flood and heavy rainfall prevention, sealing and greening measures, species protection, light pollution, use of solar energy.
During the shortened publication period, comments may be submitted by anyone in accordance with Section 4a (3) sentence 4 BauGB. In accordance with Section 3 (2) sentence 4 no. 2 BauGB, comments should be submitted electronically where possible; this can be done by email to the following address: planung@idar-oberstein.de. It is also possible to submit comments in writing or for the record. The comments will be reviewed by the City Council. The result of the review will be communicated. In accordance with Sections 3 (2) and 4a (5) BauGB, comments that are not submitted on time may be disregarded when a decision is made on the development plan. Furthermore, it is pointed out that an application pursuant to Section 47 of the Administrative Court Code is inadmissible if it asserts objections that were not asserted by the applicant during the public inspection or were asserted late but could have been asserted.
Personal data is processed on the basis of Art. 6 (1) (e) of the General Data Protection Regulation (GDPR) in conjunction with Art. § Section 3 BauGB and the Rhineland-Palatinate State Data Protection Act.
