Motor vehicle: obligation to wear seat belts and safety helmets - exemption
Service description
To protect road users, the legislator has stipulated that seat belts must be worn while driving and that suitable safety helmets must be worn when driving motorcycles.
In individual cases, however, it is possible to be exempted from this obligation upon request. The resulting considerable safety risk shall be borne by the applicant.
You may be exempted from the obligation to wear a seat belt by way of exception,
- if it is not possible to wear seat belts for health reasons.
- if the height is less than 150 cm.
You may be exempted from the obligation to wear a helmet by way of exception,
- if it is not possible to wear a safety helmet for health reasons.
What documents are required?
The above-mentioned health requirements must be verified by a medical certificate. The medical certificate must expressly confirm that the applicant must be exempted from the obligation to wear a seatbelt or helmet on the basis of the medical findings. The diagnosis does not need to be stated on the certificate.
What fees apply?
The fee is currently between EUR 10.20 and EUR 767.00 in accordance with the German Road Traffic Fee Regulations (GebOSt).
What deadlines do I have to observe?
The exemption permit is revocable and, unless the medical certificate indicates a shorter duration, is generally issued for a limited period of one year - unless the medical certificate attests to a permanent condition that cannot be improved; in this case, the exemption permit can be issued for an unlimited period.
